Whistle-blower Evaluates OECD-Aligned Asset-Recovery Tools in Case Involving Alleged Misappropriation of Hotel Asset and Use to Anchor Public-Funding Structures in the Canary Islands

Aweswell Group and its founder Gil Marer, acting as an external whistle-blower protected under EU Directive 2019/1937 and Spanish Law 2/2023, announced today that they are evaluating Spain’s OECD-aligned asset-recovery mechanisms, including potential activation of the Oficina de Recuperación y Gestión de Activos (ORGA), in relation to alleged unlawful control and commercial exploitation of a hotel asset in Lanzarote.

Allegations Filed
According to the whistle-blower filings, the Lanzarote hotel was allegedly:
Usurped through irregular insolvency processes
Integrated into commercial operations without lawful title
Used as a financial anchor to obtain and justify public-funding instruments and tax-advantaged RIC structures
Commodified and branded under hospitality operators Constructores Acosta Matos (CAM), MYND Hotels, and Canarian Hospitality while ownership remained disputed
Commercialised with diversion of revenues, and used in support of funding structures linked to pandemic-era economic measures and Canary Islands investment vehicles
All parties are presumed innocent pending judicial and institutional review.
